The Office of Legal Services provides legal services for the Transportation Cabinet, and is responsible for:
  • Legal matters relating to drafting, review and approval of Administrative Regulations and guidance manual revisions and to the review of Official Orders, contracts and memoranda of agreement
  • Board of Claims, collections, motor vehicle liability insurance and property damage claims
  • General litigation, including enforcement actions relating to junkyards and billboards, civil rights, contractor claims and liens, encroachments, condemnation, personnel issues, vehicle regulation and motor fuels and usage-tax appeals
  • Miscellaneous litigation
  • Administration of the Cabinet’s workers’ compensation program and related litigation

How to file a Board of claims
Pursuant to KRS 44.070 et seq., the Board of Claims was created to adjudicate all negligence claims against the Commonwealth. A Claim form can be found at www.boc.ky.gov or by telephoning 800-469-2120. The Board of Claims processes the completed form and the Transportation Cabinet will receive the Claim, and respond. The Board of Claims reviews all claims filed by citizens who believe their person or property has been damaged through negligence on the part of the Commonwealth of Kentucky. The Board of Claims acts under the authority of KRS Chapter 44 and KAR Title 108.

How to request a 13B Hearing
Send a request to the Office of Legal Services, who will then forward the request for a hearing to the Office of Attorney General. Services include conducting pre-hearing conferences, ruling on motions, conducting hearings, and writing findings of fact, conclusions of law, and recommended and final orders.

How to file for Workers’ Compensation
Any KYTC Employee who is injured should report the injury to their immediate supervisor. Supervisor then contacts the workers' comp coordinator at their Office/District/Division who is responsible for the paperwork to be submitted to Office of Legal Services/Workers' Comp and Risk Management Services. The necessary forms to be submitted within three (3) working days are IA-1 "First Report of Injury or Illness", "Written Notice to Employer of Work-Related Injury, and Form 106 " Medical Waiver and Consent". If the coordinator does not have these forms, contact Kelly Brown at (502) 564-0841.
Once the forms are completed, fax them to (502) 564-0843.
